Federal judge dismissed Ice Cube’s lawsuit against Robinhood
On Tuesday, a California judge dismissed a case brought by rapper Ice Cube against Robinhood, a trading platform. He was claiming that the platform used his image to promote its products without his approval.
In March, the rapper decided to sue Robinhood, alleging that it was violating trademark law and damaging his reputation by using his image and a piece of his musical lyrics. The platform made it appear as if he allowed the company to use these materials.
Laurel Beeler, U.S. Magistrate Judge, wrote in a dismissed order that Ice Cube’s complaint did not plead that Robinhood using his identity suggested his endorsement of its products. But she said that Ice Cube had to file an amended complaint in 21 days.
Ice Cube’s attorney, Sean Hardy, told Yahoo Finance, this is a simple procedure. They are confident that their amended pleading will resolve any questions. However, they are also indicating that Robinhood could not expect that this dismissal will end the dispute.
Judge Beeler said that Ice Cube mistakenly characterized the publication of Robinhood as an advertisement instead of a newsletter. Courts have not historically recognized newsletters as a basis to support the trademark claim because of its less commercial nature.
